1. Acceptance of Terms

By creating an account or using Safety Simple ("the Service"), you agree to be bound by these Terms of Service ("Terms"). If you are using the Service on behalf of a company, you represent that you have authority to bind that company to these Terms.

2. The Service

Safety Simple is an Environmental Health & Safety (EHS) compliance tool for small construction crews. The Service provides written safety program templates, training records, incident logging, AI-assisted guidance ("Sully"), and related compliance utilities.

The Service is a software tool, not legal advice. Information provided — including AI responses, OSHA references, and program templates — is general guidance only. You are responsible for verifying compliance with federal OSHA, your state plan, and any other applicable regulations. Always consult your OSHA Area Office or qualified counsel for binding determinations.

3. 7-Day Free Trial

New accounts receive a 7-day free trial with full access to paid features.
No payment method is required to start the trial.
The trial begins on the date your account is created and ends 7 calendar days later at 11:59 PM in your local time zone.
At the end of the trial, your account will revert to a read-only state unless you elect a paid subscription. We do not auto-charge.
Data created during the trial — programs, incidents, training records — is retained for at least 30 days after the trial ends and is exportable on request.
We reserve the right to modify or discontinue the trial offer at any time. Trial promotions are limited to one per company.

4. Account & Eligibility

You must be at least 18 years old and authorized to act on behalf of your company. You are responsible for safeguarding your login credentials and for all activity under your account. Notify us immediately if you suspect unauthorized access.

5. Acceptable Use

You agree NOT to:

Use the Service to falsify safety records, training attendance, or incident reports.
Resell, sublicense, or rebrand the Service without a written agreement.
Reverse engineer, scrape, or attempt to extract source code or AI prompts.
Upload malicious content, illegal material, or another company's confidential data without permission.
Use the Service in a manner that violates any applicable law or regulation.

6. Your Content

You retain ownership of company data, incident reports, training records, and other content you submit ("Customer Content"). You grant Safety Simple a limited license to process Customer Content solely to operate, maintain, and improve the Service. We do not sell Customer Content.

7. AI Features (Sully)

Sully and other AI-assisted features generate responses based on language models. Outputs may contain errors, omissions, or outdated regulatory references. You must independently verify AI-generated content before relying on it for compliance, training, or incident reporting decisions.

8. Subscription & Billing

Paid subscriptions, when activated, are billed in advance on a monthly or annual basis as selected. Fees are non-refundable except where required by law. You may cancel at any time; cancellation takes effect at the end of the current billing period.

9. Disclaimers

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. SAFETY SIMPLE DOES NOT WARRANT THAT USE OF THE SERVICE WILL RESULT IN OSHA COMPLIANCE OR PREVENT INJURIES, FINES, OR CITATIONS.

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, SAFETY SIMPLE'S TOTAL LIABILITY FOR ANY CLAIM ARISING OUT OF OR RELATED TO THE SERVICE IS LIMITED TO THE GREATER OF (A) FEES PAID BY YOU IN THE 12 MONTHS PRECEDING THE CLAIM, OR (B) ONE HUNDRED U.S. DOLLARS ($100). SAFETY SIMPLE IS NOT LIABLE FOR INDIRECT, INCIDENTAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES.

11. Indemnification

You agree to indemnify and hold harmless Safety Simple from any claim arising from (a) your misuse of the Service, (b) Customer Content, or (c) your violation of these Terms or applicable law.

12. Termination

We may suspend or terminate your account for violation of these Terms or for non-payment. Upon termination, your right to use the Service ends. You may export your data for 30 days following termination.

13. Changes to Terms

We may update these Terms periodically. Material changes will be communicated by email or in-app notice at least 14 days before taking effect. Continued use after the effective date constitutes acceptance.

14. Governing Law

These Terms are governed by the laws of the State of Delaware, USA, without regard to conflict-of-laws rules. Disputes will be resolved in the state or federal courts located in Delaware, except where applicable consumer protection law requires otherwise.
